Terms of service

This document sets out the terms and conditions for your Eversend personal account (your account) and its related services. It also sets out other important things that you need to know.

These terms and conditions, along with the Privacy Policy and any other terms and conditions that apply to our services, form a legal agreement (the “Agreement”, or the “Terms”) between:

  1. You, the account holder, and
  2. Us,  Eversend Tech Limited (Eversend).

It is important for you to understand how your account works. You can ask for a copy of these terms and conditions through the Eversend app, at any time and are also accessible at www.eversend.co.

These Terms govern your use of Eversend’s services, including mobile applications, websites, software, hardware and other products and services (collectively, the ‘Services’), whether such Services are offered by Eversend Tech Limited or an affiliate. Effective upon the earlier of your clicking “Accept” or your use of any of the Services, you accept and agree to these General Terms and any policies referenced within (‘Policies’), including terms that limit Eversend’s liability and require arbitration for any potential legal dispute. You also agree to any additional terms specific to the Services you use (the ‘Additional Terms’).

If you’d like more information, you might find it helpful to read our FAQs, but these FAQs don’t form part of our agreement with you.

The main way we provide our services is through the Eversend mobile app. However, we provide our services in other ways too, like through web pages, other apps, APIs and other means. These terms apply whenever and however you access our services. This means they apply to all the ways you can access a particular service, even if we refer to the service being accessed through a specific means in these terms. For example, when we talk about Eversend Card payments, we mean payments using a virtual card created using the Eversend Account.

Do not use the Services if you do not agree to be bound by these terms. By using the Service, you are agreeing to the terms of this Agreement.

As used throughout this Agreement, the terms “Eversend”, “We”, “Us”, and “Our” refer to Tech Limited, a company incorporated under the laws of England and Wales,, together with its affiliates, employees, directors, successors, and assignees. The terms “You” and “Your” refer to users of the Service, whether as Senders or Recipients.

1. The service

Your account is a ‘virtual’ account that holds your e-money. It may hold e-money in different currencies at the same time in what is referred to as Eversend Wallets.

E-money is an electronic alternative to cash. If you or someone else gives us money in one currency, we’ll issue an equivalent value of e-money in that currency. We’ll store the e-money in your account, and other people will accept it as payment. In these terms, we use ‘money’ to refer to e-money.

2. Using the service

Once you have e-money in your account you’ll be able to use our services. For example, you can do the following:

  1. Send money to and receive money from other Eversend accounts and non-Eversend accounts; We recommend you use the Service to send money to friends and family, and, therefore, you should not use the Service to send money to strangers. Eversend is not responsible for any losses incurred as a result of sending money to unknown recipients or participating in high-risk activities, including but not limited to private trading or investment schemes. Be aware that scams are common in these areas, and we strongly encourage you to report any suspicious activities to our customer service team.

A “Sender” uses the Service to send money and a “Recipient” receives money through the Service.

A “Transaction” refers to an order to send money through the Service. The “Transaction Amount” is the amount in sending currency that the Sender provides to Eversend for transmittal to the Recipient. The “Payout Amount” is the amount paid out to the Recipient.

  1. Change money from one currency to another (we call this a “currency exchange”). The currencies available might change occasionally;
  2. Make payments using your Eversend Wallet and Card;
  3. Withdraw the money by sending it to your mobile money or bank account; and,
  4. view information about and manage your account“Transaction” refers to an order to send money through the Service. The “Transaction Amount” is the amount in sending currency that the Sender provides to Eversend for transmittal to the Recipient. The “Payout Amount” is the amount paid out to the Recipient.

We add new features and services all the time. We’ll let you know about these through the Eversend app.

3. Eligibility of service

Age and capacity. You must be at least eighteen (18) years old to create an account, access, or use the Service as a Sender. You must be able to form legally binding contracts under applicable law. Other restrictions may apply.

When you ask us to open an account, we or someone acting for us will ask for information about you and where the money you will put in your account comes from. We do this for several reasons, including to check your credit score and identity, and to meet our legal and regulatory requirements. Our Privacy Policy explains more about how we use your information for these and other purposes. When we have the information we need, we will open your account.

Others. You may not submit or receive a Transaction on behalf of any other person.

Offer and acceptance. When you download our app and enter the necessary information, you present an offer to be bound by these terms.

Please note: 

  • You cannot open more than one Eversend personal account;
  • Use an Eversend personal account for business purposes; 
  • Open a new Eversend account if we’ve previously closed your Eversend account. (If it is established that you opened another account without our approval, please note that we can block and freeze this account pending our regulators’ approval and confirmation); or,
  • If you want to use an Eversend account for business purposes, you will need to apply for a business account under our Business Terms.

Keep us in the loop: Please keep your details up to date and let us know immediately if any information you’ve given us changes. If we discover that any of your information is incorrect, we will notify you and have the same updated.

To meet our legal and regulatory requirements we might sometimes need to ask for more information about you (for example, if your spending increases). Please provide this information quickly so that there is no disruption to your account or our services.

Multiple Accounts. You may only have one active account. If we determine that You are using multiple accounts we reserve the right to merge or terminate one or more of the accounts, limit Your use of the Service, or refuse Your continued use of the Service.

4. Paying for the service

Charges. With each Transaction you submit you are agreeing to pay us a service fee (“Service Fee”), in addition to the Transaction Amount. Payment is due at the time the transaction is submitted for processing. If you submit a transaction that results in us being charged chargeback fees or other similar costs, you agree to reimburse Eversend for all such fees. 

A Chargeback also known as a payment dispute, is a funds reversal when You or the person that sent you money disputes that transaction. To process a chargeback, there are fees involved which defer based on the payment instrument in question.

Payment. For us to process your transaction you authorise us to charge any of the payment instruments included in your payment profile (“Payment Instrument” includes any credit card, debit card, mobile money wallet, Eversend wallet, bank account or any other wallet). If your payment fails you authorise us to re-try one or more times using the same Payment Instrument. You warrant that you are an authorised and lawful user of the Payment Instrument(s).

Other charges. We are not responsible for fees that may be imposed by financial institutions associated with your Payment Instruments. For example, some credit card issuers may treat the use of your credit card to use the Service as a “cash advance” and may impose additional fees and interest costs for the transaction. Eversend is not responsible for any chargeback fees, or other, similar charges that might be imposed on you by your bank, credit card issuer, or other provider.

A list of applicable fees is provided here and within the Eversend app. Please endeavour to check the applicable fees for the particular service before you confirm a transaction.

5. Receiving a remittance

Service providers. We work with local banks, mobile telecommunication companies and other third-party outlets (each, a “Service Provider”) to make funds available to Recipients. As a Sender, you are appointing your Recipient as your agent for the purpose of receiving funds transmitted through the Service. We try to provide current information on our website about the location, availability, and hours of our Service Providers. However, we are not responsible for any inaccurate or incomplete information that may be indicated by you while processing a transaction.

Verification.  We always require you to provide your PIN or password so as to authenticate any transaction from your account as a measure of indicating that every transaction initiated from your account is only initiated or authorised by You and that no transaction can be completed without verification.

6. Important service restrictions

General. We may refuse any Transaction or limit the amount to be transferred, either on a per-transaction or aggregated basis. These limits may be imposed on individual accounts or linked accounts. We reserve the right at any time to modify or discontinue all or any part of the Service.

Delays. Your Transaction may be delayed by Our effort to verify Your identity and validate Your Payment Instruments and otherwise comply with laws or manage our financial risk. You may be entitled to a refund in certain circumstances and you may cancel your transaction at any time while it is pending. We also work with third parties (our partners to make some of the services accessible and available to you, at times, you might experience delays that may be as a result of our partners’ services.) We provide the status of the transaction and we do our best to inform you under the same the reason for the delays.

Commercial transactions. You should not use the Service to send money except to people that you know. We are not responsible for, the quality or delivery of goods or services that you pay for using the Service. You accept that using the Service to pay for goods and services or sending money to people unknown to you is at your own risk and We shall not be responsible for any loss or damage that may result from your abuse of the Service.

Unauthorised transactions. You may not use the Service in violation of this Agreement or applicable laws, rules or regulations. for illegal purposes (for example, committing fraud); You cannot use your Eversend account in the following ways, either directly or indirectly:

  • In a way that we reasonably believe might harm our ability to provide our services;
  • To send money to and receive money from a credit card account;
  • To control or use an Eversend account that’s not yours;
  • To create Eversend Cards for any other person other than yourself;
  • To allow anyone else to have access to or use your account or the Eversend app; or
  • To abuse, exploit or get around any usage restrictions set by a service provider your Eversend account or Virtual Card is registered with. For example, you must only use one Eversend Card for any particular service provider that offers a free subscription or trial period; or to trade in foreign currencies for speculative purposes (that is, to take advantage of any expected rise or fall in the value of a currency) or to take advantage of discrepancies in the foreign exchange market.

Please act in a respectful way towards US and Our support staff – We’re here to assist you.

It is a violation of this Agreement to use the Service for any of the following activities or services:

  • Sexually-oriented materials or services;
  • Gambling activities;
  • Fraud, money-laundering;
  • The funding of terrorist organisations;
  • The purchase or sale of tobacco, tobacco-related paraphernalia, firearms, prescription drugs, or other controlled substances; 
  • To send money to a Recipient that has violated the Agreement. 

If you use the Service in connection with illegal conduct, We have an obligation to report you and the alleged conduct to law enforcement.

Ineligible Transactions. We may refuse Transactions from certain Senders and to certain Recipients that are included on the Specially Designated Nationals list, Non-cooperative Countries and Territories list, and such other lists as issued by different government agencies.

Changes to a Transaction. We generally do not let You change the details of Your Transaction once it’s submitted to us for processing. It is Your responsibility to make sure Your Transaction details are accurate. As a precaution, before We honour Your payment instruction, We shall always ask You if You intend to make payment to the recipient indicated in the instruction and request You to verify Your identity through authentication.

Restricted activities. In connection with Your use of Our website or the Service, or in the course of Your interactions with Eversend, a user or a third party, You undertake not to:

  • Breach this Agreement, or any other agreement between You and Eversend;
  • Provide false, inaccurate, or misleading information;
  • Refuse to cooperate in an investigation or provide confirmation of your identity;
  • Use an anonymising proxy;
  • Provide Yourself a cash advance from Your credit card (or help others to do so);
  • Use any automatic device, or manual process to monitor or copy our website.

7. How and why we collect personal information

In order to provide you with the Services stipulated under this Agreement, it is necessary for us to collect and process certain personal information about You. We are committed to maintaining the confidentiality, integrity, and security of Your personal data in accordance with the relevant data protection legislation.

For detailed information regarding the types of personal data We collect, the basis for its processing, how it is used, and Your rights in relation to Your personal data, please refer to our Customer Privacy Notice, which is available here. This notice forms an integral part of the Agreement and should be read in conjunction with it.

By entering into this Agreement, You expressly consent to the collection, processing, and storage of Your personal information for the purposes of administering, managing, and providing the Services agreed upon. This includes any activities necessary for the performance of the Agreement and compliance with legal obligations to which we are subject.

Please be assured that Your rights under data protection law are fully upheld and respected. You retain the right to withdraw Your consent at any time, request access to the personal data we hold about You, seek rectification or erasure of Your personal data, restrict processing, object to processing, and exercise your right to data portability, subject to the conditions and limitations set forth in the applicable laws.

By entering into this Agreement You are giving us permission to gather, process, and store Your personal information for the purpose of providing Our services to You. This doesn’t affect any rights and obligations You or We have under data protection laws.

8. Error resolution, cancellation and refunds

Error Resolution. Let us know at any time if You have any problems with the Service. You can contact Us using the contact information at the bottom of this Agreement or by sending an email to support@eversend.co.

Cancellation. If a payment is scheduled to be paid from Your account in the future (like a recurring payment), You can cancel it using the Eversend app at any time before the end of the business day before it is due to be paid. You cannot cancel the transaction once it has been completed. This means that You can’t cancel any payment which You ask us to make instantly (like an Instant Transfer or a currency exchange). For the purposes of this agreement, a transaction shall be deemed “completed” once the payment instruction has been credited to the recipient, which may occur through either a wallet delivery or a bank account deposit. Once a transaction reaches completion, the Transaction Amount becomes non-refundable. 

We encourage you to review all transaction details thoroughly before confirming any transfer, especially in the case of Instant Transactions, to ensure the accuracy and intentionality of your transaction.

9. Duration and timeframe for Payments

We understand that when you make a payment, one of the most important things is that the person the payment is for receives it on time. When their intended account will receive the money depends on the processing conditions of that particular jurisdiction and the currency you want us to make it in.

All our payments for Eversend-to-Eversend wallets are instant and where there are any delays, the reason for the delay is always indicated in the transaction status, at times We may hold the transaction for compliance checks as may be required by law from time to time, and whenever this happens, we indicate it under the transaction status.

Refusal or Delayed Payments: We are mandated to refuse to make a payment or delay a payment (including inbound and outbound payments) in the following circumstances:

  • If legal or regulatory requirements prevent us from making the payment or We need to carry out further checks;
  • If You have acted in breach of these terms and conditions in a way that we reasonably believe justifies Us refusing or delaying Your payment;
  • If We believe that processing Your instruction shall be in breach of these terms and conditions or that Your instruction doesn’t contain all the information We need to make the payment properly;
  • If the amount is over or would take you over, any limit that applies to Your account. We’ve set out the limits under the Profile button in the Eversend App. Please endeavour to check account limits that apply to You as these are set on a jurisdictional basis as set by our regulators.
  • If there is not enough money available in Your account to make the payment and cover any charge;
  • If a bankruptcy order is made against You or You’ve entered into an individual voluntary arrangement with Your creditors;
  • If, even after doing everything reasonably possible, We won’t be able to make the payment on time;
  • If a third party prevents Us from making the payment (for example, if your bank or payment processor does not allow a payment or cash withdrawal using Your Eversend Wallet or Virtual Card);
  • If You owe Us money or We intend to exercise Our right of set-off (as explained in these terms);
  • If We have asked You for important information We reasonably need and You have not given Us that information; or,
  • If We have suspended Your account

We may also refuse to issue a new Eversend Card if You do not have enough money in Your account to pay Us to issue the card.

When We refuse to make a payment, We’ll always try to let you know.

If We can, We’ll use the Eversend app to inform You that We have refused to make a payment. If You’d like to find out why We refused the payment, and what you can do to solve any problem, please contact us through the app or by mailto: support@eversend.co

We won’t be responsible for any losses You suffer as a result of Us refusing or delaying a payment.

11. Unauthorised Transactions/Payments

If You think someone has stolen from your account, let us know as soon as possible through the Eversend app (and no later than 12 months after the money was taken). We’ll pay the money back into your account if:

  • You couldn’t have known that Your security details were at risk of being misused;
  • The payment happened because someone We are responsible for made a mistake;
  • The payment was taken after You told us that someone knew Your security details were compromised, or We didn’t give You a way to tell Us about this; or
  • The law required Us to make You follow certain prompts when You instructed Us to make the payment and we didn’t do this.
  • We’ll also pay back any charges You had to pay as a result of the payment being taken from Your account.

We won’t refund any money if You’ve acted fraudulently, or You intentionally or carelessly failed to keep Your security details safe (unless You told us about this before the payment was taken from Your account). For example, We won’t refund You if You gave someone Your PIN or Card and they made a payment using Your wallet or card without You knowing about it.

12. Restricting your Account

The safety of Your money is important to Us and Our platform is important to Us. We might prevent You from making payments from Your account or with Your Eversend Card if We’re reasonably concerned about its security or that it might be used fraudulently or without Your permission.

We might also have to block Your account or Eversend Card to meet Our legal obligations.

We’ll inform You through the Eversend app before, or as soon as possible after, We block Your Eversend app or Card. We’ll also let You know why we’ve done it (unless it would reduce Your or Our security or it would be unlawful)

Suspending and Closing Your Account. We may close or suspend Your account immediately, and end Your access to Our app and website, in exceptional circumstances. Exceptional circumstances include the following:

  • If We have good reason to suspect that You are behaving fraudulently;
  • If You haven’t given Us (or someone acting on Our behalf) any information We need, or We have good reason to believe that information You have provided is incorrect or not true;
  • If You have acted in breach of these terms and conditions in a serious or persistent way and You haven’t put the matter right within a reasonable time of Us asking You to;
  • If We have good reason to believe that Your use of the Eversend app is harmful to Us or Our software, systems or hardware;
  • If We have good reason to believe that You continuing to use Your account could damage Our reputation or goodwill;
  • If we have asked You to repay money You owe Us and You have not done so within a reasonable period of time;
  • If You’ve been declared bankrupt; or
  • If We have to do so under any law, regulation, court order or ombudsman’s instructions.

We may also decide to close or suspend Your account for other reasons. We shall contact You through the Eversend app before We do this.

Closing Your Account and ending the agreement may also end any other agreements You have with Us or through Us. You can get more information through the Eversend app or by contacting Us by mailto: support@eversend.co.

13. Service Interruptions

We do as much as reasonably possible to make sure that Our services are not interrupted and are accessible at a reasonable speed. However, We can’t promise that this will always be the case or that the services will be free from faults. We also rely on some third parties to provide services to You, which can sometimes disrupt Our services. We’ll always do Our best to solve any problems with Our services, no matter what the cause.

If you have an Eversend Card, We will let You know about any changes to Our system that will affect Your ability to use the card. Should there be need to migrate Your Card, We shall inform You first and where not possible, the money on Your card shall be transmitted to Your corresponding wallet.

We will not be held liable for any losses that occur if We are unable to fulfill Our obligations regarding payments to or from Your account due to the following reasons:

  • You have violated these terms and conditions or engaged in unlawful activities.
  • We are required to act or refrain from acting by law or regulatory mandates.
  • Events beyond Our control, such as natural disasters or other unforeseeable and unavoidable events, prevent Us from fulfilling Our obligations.

In such instances, Our inability to process payments as expected does not constitute a failure on Our part to provide Our Services according to these terms.

If You find Yourself unable to use Your Eversend Card for any reason, Our sole responsibility to You will be to issue a replacement card.

If We act in breach of this agreement, We are only responsible for only reasonably foreseeable losses at the time We entered into this agreement with You.

Nothing in these terms and conditions removes or limits Our liability for death or personal injury resulting from Our negligence or from fraud or fraudulent claims and statements.

14. Negative Balances

You cannot overdraw Your account, meaning You cannot spend more than the available balance. However, You might have the opportunity to utilise one of Our credit offerings. Should Your account balance become negative, for instance due to insufficient funds to cover applicable fees, You are required to promptly deposit sufficient funds to restore a positive balance.

Should You not address a negative balance, or if You have outstanding fees (excluding third-party fees for transactions) or other dues, We reserve the right to deduct the owed amounts from any payments We might owe you, or from any other accounts You hold with Us, either individually or jointly, at any time and without prior notice. This is known as Our right of ‘set-off.’ We may also convert the necessary funds from another currency/wallet You hold with Us to cover the deficit, based on the current exchange rate.

In cases where Your account lacks the funds to cover Our listed fees or other amounts You owe, We may seek repayment through alternative means, and will notify You in advance of taking such actions, which may include:

  • Deducting the owed amount from a payment instrument You’ve stored with Us.
  • Undertaking recovery actions, such as:
    • Engaging a debt collection agency.
    • Initiating legal action to recover the debt.
    • Reporting to fraud prevention agencies where allowed.
    • Selling or transferring the debt to a third party.

Should We resort to any of these measures, You shall be responsible for covering Our reasonable expenses incurred in the process, which could include additional charges like top-up surcharges, increased currency exchange rates during weekends, costs associated with debt collection agencies, or legal fees.

We urge You to contact Us through in-app chat for assistance if You are facing financial difficulties.

Please be aware that You might also be liable for taxes or other charges related to transactions made or received through Your account, which are not our responsibility to collect. This could potentially result in a negative account balance, so it’s important to stay informed about Your tax obligations.

15. Third Party Services

During Your use of Our Services, You might encounter offers for services, products, or promotions from entities other than Eversend, referred to as ‘Third Party Services.’ Choosing to utilise these Third Party Services means You are responsible for familiarising Yourself with and accepting their specific terms and conditions. Please note that Eversend, including its affiliates, does not guarantee the quality, reliability, or performance of any Third Party Services.

Our services may also include links to websites operated by third parties. These links are provided for Your convenience and do not signify Eversend’s endorsement or approval of the linked sites or their content. Remember, these external sites are not covered by Our Terms and Conditions or Privacy Policy. You are accessing and using any such third-party websites entirely at Your own risk, and any interaction or engagement You have with these sites is governed by their own policies and not by Eversend’s.

Eversend explicitly disclaims all liability related to third-party websites and services. Your protection under Eversend’s Privacy Policy ceases once You navigate away from Our services to a third-party site.

16. Complaints

If You find Yourself dissatisfied with any aspect of Our service, We are committed to addressing Your concerns.

We strive for excellence in all We do, but We acknowledge that occasionally issues may arise. If You encounter any problems or wish to make a complaint, We encourage You to reach out to Us directly. We are here to help and aim to resolve any issues to Your satisfaction.

If You have concerns or issues You’d like to discuss, Our team is ready to assist You directly through the Eversend app. It’s often the fastest way to address and resolve any problems. When reaching out, it may be helpful to have the following information ready:

  • Your full name
  • The phone number and email linked to Your account
  • A brief description of the issue and when it occurred
  • Your preferred resolution

Alternatively, if You’d like to formally submit a complaint, You can send an email to support@eversend.co.

Please include all the details listed above in Your complaint. Once We receive it, We’ll thoroughly investigate the matter and get back to You via email. Our communication will primarily be in English, unless We specify otherwise.

17. Eversend's intellectual property

You acknowledge that the Service, including the content of this website, text, graphics, logos, and images, as well as all other Eversend copyrights, trademarks, logos, and product and service names are owned exclusively by Eversend Tech Limited (the “Eversend Intellectual Property”). You agree not to display, use, copy, or modify the Eversend Intellectual Property in any manner. You are authorised solely to view and retain a copy of the pages of this website for Your own personal, non-commercial use. You further agree not to: (i) use any robot, spider, scraper or other automated device to access the Service; (ii) remove or alter any author, trademark or other proprietary notice or legend displayed on this website (or printed pages thereof); or (iii) infringe Eversend’s or any third party’s copyright, patent, trademark, trade secret or other intellectual property rights, or rights of publicity or privacy.

18. Liability and Indemnity

Eversend provides its services to You based on these terms. It’s important to understand that Eversend is not liable for any issues that might arise from fulfilling or failing to fulfill any obligations outlined in these terms, including any responsibilities of Eversend Tech Limited.

However, there are exceptions where liability cannot be excluded or limited under these terms. These include instances of:

  • Death or personal injury caused by negligence on Our part.
  • Fraudulent misrepresentation or any other fraudulent behaviour.
  • Breach of any laws that imply certain guarantees about the services We supply.
  • Any other liabilities that the law does not allow Us to exclude or limit.

Eversend, including any of its affiliates, will not be liable for any financial losses such as lost profits, sales, business, or anticipated savings; loss of contracts or customers; damage to reputation or goodwill; lost data or software; wasted staff time; or any indirect or consequential losses that arise from these terms, regardless of whether such losses were foreseeable or not.

Additionally, Eversend won’t be liable for losses that result from:

  • Using the service in a way it was not intended.
  • Any changes or modifications to the Service not approved by Eversend.
  • Adhering to any instructions, designs, or specifications You provide.
  • Content or services provided by merchants or third parties.

Specifically, if money is sent to and then withdrawn from an account, Eversend is not liable. Our platform includes features that minimise risks by only allowing You to send money to contacts You’ve added as beneficiaries. If You proceed with a transaction after being prompted for Your pin or password, Eversend won’t be held responsible, nor will it be obligated to reverse the transaction.

Eversend’s total liability for any claims related to these terms will be limited to the greater of the total payments made by You in the three months prior to the claim or USD 500.

You also agree to protect Eversend, its service providers, and their affiliates from any claims, including legal fees, that arise from Your use of the service, any breach of these terms, or infringement of others’ rights.

19. Disputes

In the event of a dispute, You and Eversend agree to resolve any claims through binding arbitration. Arbitration will be initiated through an agreed-upon alternative dispute resolution (ADR) provider. The process will adhere to these guidelines:

  • Arbitration may be conducted via phone, online, or based on written submissions, as chosen by the initiating party.
  • Personal appearances by any party or witnesses will only occur if mutually agreed upon.
  • The arbitrator will not combine multiple claims into a single proceeding nor lead any class action or representative proceedings.
  • The arbitrator’s decision can be enforced in any competent court.

By agreeing to arbitration, both You and Eversend waive the right to a trial and to participate in any class action or representative legal actions.

If decide to take legal action against Us in the courts, only the courts of England and Wales can deal with any matter relating to these terms and conditions.

20. Communications

By agreeing to this Agreement, You understand it’s made electronically, and all related communications will be delivered in the same way, including:

  • The Agreement itself, along with any amendments, modifications or supplements to it.
  • Details of Your transactions using Our Service.
  • Any required legal notices or other disclosures.
  • Customer service communications, such as error notifications or alerts on unauthorised use.
  • Any other information about Your use of Our Service or Your relationship with Eversend.

We might send these communications via automated calls, pre-recorded messages, or text messages to the phone numbers You provide. Note that standard call or message charges could apply. To access and keep these electronic communications, You’ll need a device that can get online, a web browser, and a way to print or save documents.

If You decide You no longer want to receive information electronically, which will mean You can’t use Our Service anymore, You’ll need to let Us know. You can withdraw Your consent by getting in touch with Us using the contact details provided at the end of this Agreement.

21. Legal bits and pieces

Entire agreement. The Agreement constitutes the entire agreement between you and Eversend and governs your use of the Service, superseding any prior agreements between you and Eversend.

No waiver. The failure of Eversend to exercise or enforce any right or provision of the Agreement shall not constitute a waiver of such right or provision. If any provision of the Agreement is found by an arbitrator or court of competent jurisdiction to be invalid, the parties nevertheless agree that the arbitrator or court should endeavour to give appropriately valid effect to the intention of the Agreement as reflected in the provision, and the other provisions of the Agreement shall remain in full force and effect.

Force majeure. We shall not be liable for any failure or delay in the performance of the Service to the extent such failure or delay is caused by matters beyond our reasonable control, including, without limitation: changes in applicable laws; closure or unavailability of required physical and network infrastructure; sovereign default; power or internet failure; civil unrest; war; and earthquake, fire, flood, or other natural disasters.

Modification. We may modify this Agreement from time to time without notice to you, except as may be required by law. You can review the most current version of the Agreement at any time by reviewing this website. You may terminate your use of the Service if you do not agree with any modification or amendment. If you use the Service after the effective date of an amendment or modification, you shall be deemed to have accepted that amendment or modification. You agree that you shall not modify this Agreement and acknowledge that any attempts by you to modify this Agreement shall be void.

Other terms. This Agreement may be supplemented by terms applicable to other promotions, our Referral Program, and other terms applicable to you based upon your use of the Service. These terms are incorporated into this Agreement by reference. To the extent that any of these terms are determined to be in conflict with this Agreement, this Agreement shall control.
